Cases

Settlements in 2011


1.  Martin v Robins (11 January 2011)


Female, aged 34. Pedestrian walking her 4 year old son, when a trailer ran onto the pavement striking her and fatally injuring her son. The Claimant suffered multiple cervical and thoracic spinal fractures, a compund fracture to her left tibia and facial fractures. She developed PTSD. She recovered remarkably well from these injuries and according to the Defendants medical expert was fit to return to work. Agreed settlement at £125,000 


2.  Brinson v Wincanton Group Ltd (Jan 2011)


Female aged 59. Injured her right arm at work, developed post traumatic tennis elbow. Accident was not witnessed and not recorded for 14 months. Defendants denied accident had happened as alleged and served witness evidence in support. Case accepted as a CFA. Carefully worded witness statement drafted. Case settled 7 days before trial for £40,000 net of CRU


 


Settlements in 2010


1.  Mould v Esso Petroleum


Male, aged 62. Diagnosed with HAVS and developed Depressive Disorder. Employment terminated Feb 2010. Liability admitted. Agreed settlement at £105,000


2.   Brezezkiewicz v Gholam


Male, aged 41 sustained fatal injuries in RTA. Fatal Accidents claim on behalf of wife and 2 young children, including one diagnosed with autism. Dependency claim included loss of care provided by Deceased. Liability admitted. Agreed settlement at £435,000


 3.   Greig v Pfizer  (23rd Sept 2010)


Male, aged 55, injured neck when attempting to open very stiff valve. The existence of a cervical disc lesion and the resultant spinal myoclonus was the subject of dispute between medical experts.

Liability admitted.

Settlement agreed at £40,000


4.   Davies v East London Bus Group (24th September 2010)



82 year old male pedestrian knocked down by a bus, double above knee amputation.

Agreed settlement at £375,000, taking into account a likely apportionment of liability at 80% -  20%


 5.   Higgins v Hotchkiss Engineers (10th Nov 2010)


56 year old male, work accident. Severe comminuted fracture of left humerus (right handed) involving elbow joint. Permanent and significant disability including loss of movement. Developed major depression and PTSD. Unable to work since accident in Nov 2005 and future work prospects uncertain. Liability admitted. Agreed settlement at £250,000.


Settlements in 2009


1.   Turner v Polimeri Europa


Male aged 53. Suffered lumbar disc prolapse when attempting to close a very tight valve. Back surgery unsuccessful. Developed psychological upset. remaining medical issue over nature and extent of remaining back symptoms. Liability admitted. Agreed settlement at £225,000


2.  Izzett v Hyde Housing Association


Female aged 34. Bicycle struck protruding kerb stone, Claimant thrown heavily to the ground. Closed head injury involving brain damage, loss of cognitive functioning and psychological upset. Liability agreed 2/3 1/3 in Claimant's favour. Agreed settlement at £300,000 


3.  Graves v Keaney


Male aged 33 years. RTA motor cyclist sustained multiple injuries including fractures to femur, knee cap and fingers. Traumatic injury to sciatic nerve. Ongoing vascular problems. Restricted ability to work. Liability agreed. Settlement agreed at £387,500.


4.  Glover v Stevenson and Co-Operative Insurance


Male aged 45 years. Police officer, deliberately run over by offender. Liability not in dispute. Fracture of mid shaft of fibula, suffered DVT. Developed post phlebitic syndrome, long term problems with walking, standing and sitting. Restricted to office type duties, no front line policing. Agreed settlement at £117,500


5.  De ST Croix v Kone PLC


Male aged 32 years. Senior lift engineer, caught dominant right hand in lift mechanism, sustaining serious crush injury causing permanent 50 % disability. Liability agreed previously at 85-15% in Claimant's favour. Agreed settlement at £210,000 net


6.   Harris v Forbes. (Oct 2009)


Male police officer aged 51 years. Life threatening injuries including major abdominal injuries with surgical removal of small bowel and part of large bowel. Ongoing and frequent loose motions with occasional soiling. Psychological upset and various orthopaedic injuries. He had completed 30 years service with the police, but future work prospects restricted severely. Liability agreed. Agreed settlement at £175,000. 


Settlements in 2008


1.   Gorman v MOD


Female 33. Aircraft mechanic, tripped and fell out of helicopter on board air craft carrier. Suffered significant hip fracture, limited to semi sedentary work. Liability previously agreed at 2/3 - 1/3 in Claimant's favour. Agreed settlement at £238,000


2.   Hill v McNally


Male, 27. Motor cyclist involved in RTA. Head injury and serious back injuries, psychological upset. Substantial award for loss of earnings. Agreed settlement at £230,000


3.   Goodey v J.Sainsbury


Female, 31. Injured her back in lifting accident at work. Liability previously agreed at 75% 25% in Claimant's favour. Settlement agreed at £90,000 plus CRU recoupment 


4.   Bewshear v Leask


Female aged 56. Knocked over when crossing at a pelican crossing. Claimant had no recollection of the event having been knocked unconscious. Liability disputed on basis Claimant stepped out when lights were green for traffic. Claimant won 100% liability. Case eventually settled for £50,000


5.   Batterby v Siriwardena


Male, 54. Cyclist involved in RTA. Assorted orthopaedic injuries and psychological upset. Agreed settlement at £15,000


6.   Brown v Bmghm & Solihull Mental Health NHS Trust


Female, 63. Nurse assaulted by patient at work. Multiple soft tissue injuries and psychological upset. Agreed settlement at £14,000


7.   Sinclair v Sinclair (Portsmouth County Court 28th Feb 2008)


Female, 63. Passenger in RTA. Very serious hip fracture leading to hip replacement. Continuing partial loss of earnings. Agreed settlement at £140,000


 8.   Minett v Chief Constable of W. Midlands Police


Male police officer injured during training exercise. Injury to right thumb, developed chronic pain disorder. Settlement agreed at £50,000 (19th March 2008)
