Laura is a specialist Personal Injury and Clinical Negligence practitioner. Her Personal Injury practice is mostly Claimant based and she has particular expertise in employer’s liability claims and criminal injuries compensation claims. She is regularly instructed by major Trade Union firms in disease claims including asbestos related litigation and deafness as well as manual handling and more general accidents at work claims.



She is regularly instructed in criminal injuries claims and has considerable experience of appeals before the Criminal Injuries Appeal Panel concerning matters of eligibility and quantum. She has been instructed in a number of judicial review claims against the Panel and the Authority.



Laura has also been instructed in a broad range of Clinical Negligence claims from delayed diagnosis of cancer resulting in amputation of limbs to misdiagnosis of a peri-orbital bleed resulting in blindness.

Cases

X v CICAP 2008 Highly complex case in which Laura, led by Grahame Aldous QC succeeded in obtaining a total award of £4.9 million net of all benefit deductions in respect of a badly brain damaged child. No deductions were made for current local authority care and future care was awarded on the basis of a regime of 24 hour care with carers coming into the child’s adapted home.



Palfrey v CICAP 2009 Laura represented a seriously brain damaged victim of crime whose reasonable 24 hour care needs were catered for free of charge by the Local Authority and in respect of whom the CICA had previously made an award of £212,000. On appeal Laura convinced the Panel that not only was there a need for top up care but also that an award could be made for the contingency that Local Authority funding might fail or be inadequate in the future resulting in an award of £475,000 net of benefits.



Norfolk v My Travel Group Plc (2004) 1 Lloyds Rep 106 : Acting for Defendant in trial of a preliminary issue as to whether a damages claim for personal injuries pursued under regulation 15 of the Package Travel, Package Holidays and Package Tours Regulations 1992 was time barred by Article 16 of the Athens Convention 1974.  Claim found to be time barred.

 

Charlotte v Jillet  Dependency claim in respect of a widow, daughter and mother. Deceased died in her early 60’s, net earnings were just £7,000 per annum, but she routinely cared for and purchased items for her elderly mother, her adult daughter and granddaughter:  settlement of £230,000 comprising mostly of a loss of services claim.

 

Clinical Negligence claims

Laura has experience of clinical negligence claims covering diverse issues such as the contraction of MRSA; failure to review a diabetic patient who presented with rubeosis in his one good eye after glaucoma surgery, leading to blindness; inappropriate use of  unlicensed Armour thyroxin leading to poisoning; delayed diagnosis of a soft tissue carcinoma resulting in hemipelvectomy and significantly reduced life expectancy, and  failed cosmetic procedures.

Publications

Laura is the co-author of Criminal Injuries Compensation Claims published by the Law Society. She is also a contributor to Kemp & Kemp’s The Quantum of Damages  and  Personal Injury Law, Practice and Procedure and contributes to a number of other publications including the Journal of Personal Injury Law.
